Welcome to Popmate. These Terms govern your use of the Popmate iOS/iPadOS app. By downloading, installing, or using Popmate, you agree to these Terms and our Privacy Policy.
1. Eligibility
Popmate is intended for users who are at least 18 years old. If you are under 18, you may not create an account or use the Service. We may suspend or delete accounts we reasonably believe belong to users under 18.
2. The Service
Popmate offers a collection of casual mini-games, personal score records, optional account sync, and social features including friends, activity feed, and in-app chat.
Available games include Snack Snatch, Memory Rush, Sushi Rush, Treasure Dash, Stack Duel, Bubble Battle, Pipe Sprint, Mole Mayhem, Color Clash, Bomb Pass, Pocket Curling, and Mirror Mates. We may add, update, or remove games in future versions.
Gameplay runs on your device. You can play with your selected pet and choose a difficulty level (Easy, Normal, Hard). Available game modes may display public profile information, including nicknames and pets. Scores are saved as your personal game records.
Friends, activity feed, and chat require an internet connection and use our online service. The activity feed is visible to your game friends. Chat supports text, in-app pet stickers, and game invites.
The Service is offered only to users located in the United States. If you are located outside the United States, please do not access or use the Service. Access from outside the United States is at your own discretion, and your information will be handled in accordance with our Privacy Policy and applicable law.
3. Accounts
You can use Popmate in two ways:
Guest. You may try Popmate without signing in. The app stores a guest identifier on your device's keychain to restore the same guest identity on this device and obtain a session when connected. Guest scores are saved on your device and can sync when an online guest session is active.
Sign in with Apple. You may create an account using Sign in with Apple. We submit a one-time challenge and Apple-issued identity token to our server to establish a session. The app does not read or upload the name or email associated with your Apple ID. The display name in Popmate is the nickname you choose.
Nicknames can be up to 24 characters. You choose a pet from five built-in options. The avatar is provided by the app; you do not need to upload a photo. Your nickname and pet are public and may appear on your profile, in matches, among friends, in the activity feed, and in chat.
You are responsible for activity under your account and for keeping your device secure. Do not impersonate others or use infringing, misleading, or offensive nicknames.
When linking a guest account to an Apple account, we attempt to carry over scores from the guest identity. If the Apple identity already has a Popmate account, we restore that account rather than merging scores from another player.
Signing out revokes the current online session and clears locally stored session and profile cache. Signing out does not delete your account on the server. Deleting the app removes locally stored data; system backups may retain copies.
Deleting your account. You may delete your account at any time from your profile page by selecting Delete Account. When you delete your account, we will delete or de-identify your online personal data, except where retention is required by law or necessary to resolve ongoing disputes.
4. Your Content
Your nickname, chat messages, stickers, game invites, reports, and game results you choose to share are your content.
You retain ownership of your content. To operate Popmate, you grant us a non-exclusive, royalty-free license to host, reproduce, transmit, and display your content as needed to provide and protect the Service. The activity feed is visible to your game friends. Chat messages are visible to the other participant. This license ends when you delete the content or your account, except for copies retained for security, dispute resolution, or legal obligations as described in our Privacy Policy.
You confirm that you have the right to provide your content and that it does not infringe others' rights.
Do not submit or share content that:
- Is illegal or promotes illegal activity
- Is harassing, threatening, hateful, or sexually explicit
- Infringes privacy, publicity, trademark, or copyright
- Impersonates others, is fraudulent, or constitutes spam
- Contains malicious code, mass registration, or automated interference with the Service
- Includes other players' private contact information or unsolicited marketing
Pet stickers provided in the app are not your property.
5. Reporting and Blocking
You may report activity feed posts for reasons including spam, harassment, inappropriate content, and other concerns, with an optional short note. Reports are used only to handle the reported content. You may block other players; after blocking, the app will no longer show you chats, friend connections, or activity from that player.
We may remove content, restrict features, or discontinue online service based on reports, complaints, or our own review.
6. Acceptable Use
You agree not to:
- Probe, interfere with, or bypass the Service's security or access controls
- Access other players' accounts, credentials, or non-public data without authorization
- Modify the client to falsify scores, identities, or match results, then submit those results to the Service
- Conduct automated scraping beyond normal gameplay
- Sell, rent, or transfer your account
- Use Popmate for any purpose prohibited by applicable law
Scores are recorded by the client and uploaded. Syncing preserves your personal records. The current version does not offer public leaderboard rewards.
7. Intellectual Property
The Popmate name, interface, pet designs, game graphics, sound effects, stickers, and software belong to Popmate or its licensors. These Terms do not transfer any rights to you.
Subject to your compliance with these Terms, we grant you a personal, non-transferable, non-exclusive, revocable license to use Popmate on Apple devices you own or control. You may not copy, modify, reverse engineer, rent, or distribute the app, except where applicable law does not allow us to restrict these activities.
If you believe content in Popmate infringes your rights, contact us at support@popmate.com with information sufficient to locate the content.
8. Fees
The current version of Popmate is free to download and use. There are no in-app purchases, subscriptions, paid entry, or advertisements. Apple may charge fees for your device, network, or Apple ID, which are not controlled by these Terms.
If we introduce paid features in the future, we will disclose pricing, content, and renewal terms before purchase and update these Terms.
9. Service Changes and Availability
We maintain Popmate but do not guarantee uninterrupted, error-free, or permanently available service. When offline, you can still play installed games with your pet; sync, matching, friends, feed, and chat may fail. Locally saved scores are retained and will sync when connection is restored.
We may suspend online features for security, compliance, or operational reasons.
10. Disclaimer and Limitation of Liability
Popmate is provided "as is" and "as available." To the maximum extent permitted by law, we disclaim all implied warranties, including merchantability, fitness for a particular purpose, non-infringement, and warranties that the Service is uninterrupted or error-free.
To the maximum extent permitted by law, we are not liable for indirect, incidental, special, consequential, or punitive damages, including lost profits, data, goodwill, or opportunity. Our total liability for any claim arising from these Terms or Popmate is limited to the amount you have paid us for Popmate in the twelve months preceding the claim; since the current version is free, this amount may be zero. This does not exclude liability that cannot be limited under applicable law, including willful misconduct or mandatory consumer rights.
Some jurisdictions do not allow the exclusion or limitation of certain warranties or damages. If you live in such a jurisdiction, the above limitations apply only to the extent permitted by your local law.
11. Term and Termination
These Terms remain in effect while you use Popmate. You may stop using the Service and delete the app at any time.
If you materially breach these Terms, or if we must do so to comply with the law, we may discontinue online service to your account. Upon termination, your license to use online services ends. Provisions that by their nature should survive termination will survive, including intellectual property, the license you have granted, disclaimers, limitations of liability, and dispute resolution.
12. Changes to These Terms
We may update these Terms. If changes materially affect your rights or obligations, we will notify you in the app or through our published contact information and update the version number.
Your continued use of the online Service after changes take effect means you accept the updated Terms. Where the law requires separate consent, we will obtain it.
13. General
These Terms constitute the entire agreement between you and us regarding Popmate and supersede prior agreements on the same subject. If any provision is held invalid, the remaining provisions remain in effect. Our failure to enforce any right does not waive that right. You may not transfer your rights under these Terms without our consent; we may transfer these Terms in connection with a merger, reorganization, or sale of our business.
Apple is not a party to these Terms and is not responsible for Popmate's content or maintenance. Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce these Terms against you as if they were a party. Your use of the app is also subject to the Apple Media Services Terms.
14. Governing Law and Dispute Resolution
14.1 Governing Law
These Terms and any dispute or claim arising out of or in connection with them, their subject matter, or their formation (including non-contractual disputes or claims) shall be governed by and construed in accordance with the internal laws of the State of Delaware, United States, without giving effect to any choice or conflict of law provision or rule.
14.2 Informal Resolution
Before commencing arbitration, you agree to first contact us at support@popmate.com with a written description of the dispute and the relief sought, and to attempt in good faith to resolve the matter informally for a period of thirty (30) days from the date of that notice.
14.3 Mandatory Binding Individual Arbitration
PLEASE READ THIS SECTION CAREFULLY. IT AFFECTS YOUR LEGAL RIGHTS, INCLUDING YOUR RIGHT TO FILE A LAWSUIT IN COURT.
Any dispute, claim, or controversy arising out of or relating to these Terms, the Service, or the breach, termination, enforcement, interpretation, or validity thereof (collectively, "Disputes") shall be resolved exclusively by final and binding individual arbitration, rather than in court, except that you or we may assert claims in small claims court if the claims qualify.
The arbitration shall be administered by the American Arbitration Association ("AAA") under its Consumer Arbitration Rules then in effect, and shall be conducted by a single neutral arbitrator. The arbitration shall be conducted on the basis of written submissions, by telephone, or by videoconference, unless the arbitrator determines that an in-person hearing is necessary, in which case the hearing shall take place at a location reasonably convenient to you. Judgment on the award rendered by the arbitrator may be entered in any court having jurisdiction thereof.
14.4 Class Action and Jury Trial Waiver
YOU AND WE AGREE THAT EACH PARTY MAY BRING CLAIMS AGAINST THE OTHER ONLY IN AN INDIVIDUAL CAPACITY, AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS, CONSOLIDATED, OR REPRESENTATIVE PROCEEDING.
Unless both you and we agree otherwise, the arbitrator may not consolidate more than one person's claims, and may not otherwise preside over any form of a representative or class proceeding. YOU AND WE HEREBY WAIVE ANY CONSTITUTIONAL AND STATUTORY RIGHTS TO GO TO COURT AND HAVE A TRIAL IN FRONT OF A JUDGE OR A JURY.
14.5 Right to Opt Out of Arbitration
You may decline this arbitration agreement by sending written notice to support@popmate.com within thirty (30) days of the date on which you first accept these Terms, stating your account identifier and your intention to opt out. Opting out of arbitration will not affect any other provision of these Terms or your continued use of the Service.
